Five men accused of killing two Crime Intelligence officers in an ambush in Durban applied for bail in the Verulam Magistrate's Court on Friday, 16 October 2026, according to a published report. The accused are presumed innocent and the allegations have not been tested in court.
Captain Louis Nel and Sergeant Mandlakhe Khuzwayo were ambushed in Mount Edgecombe on 30 April. Nel died at the scene and Khuzwayo died in hospital weeks later.
The charges and what the state alleges
Smangaliso Tembe, Mduduzi Myeza, Bongani Zulu, Wandile Nyawo and Sibusiso Sibisi face charges of conspiracy to commit robbery with aggravating circumstances, robbery with aggravating circumstances, murder, and unlawful possession of automatic firearms and ammunition.
According to the charge sheet, the attackers took R900,000 in cash and a pistol from the officers. The state alleges that between February and April the men conspired with others to steal cash from the police Crime Intelligence Secret Service account, and that they acted in common purpose. None of the men has been found guilty.
The ambush and the police raid
Police identified six suspects. Five were arrested in Pinetown, Amanzimtoti, Mandeni and Newlands West. The sixth was fatally wounded during a police raid at Emaplasini in Inanda.
Police spokesperson Colonel Robert Netshiunda said the standoff lasted about three hours and that negotiations continued throughout. He said the suspect refused instructions and opened fire from inside the property, and that a Special Task Force officer was shot in the hand. These are police accounts and have not been tested in court.
What we do not yet know
- Whether bail was granted or refused, and the next court date. The report we reviewed says the matter was still being heard.
- How far the hearing got. A separate report published the same day says a legal team was not ready for the bail hearing, so the two need reconciling.
- Whether more suspects are being sought.
- Any evidence beyond the state's allegations in the charge sheet.
- Second confirmation needed: the charges, the R900,000 figure and the raid details come from one report. Check them with the court roll and a police statement.
